HOLY COW! Just got word that we passed ROFR in 11 days! I certainly wasn't expecting this so fast and was expecting Disney to take the contract....Realtor says I will receive "closing documents in about 4 weeks". YEAH!

YAYYY!!! I would have been surprised if they took this one, but it's a great contract in any case :daisy:
 
Passed today so no more worrying going into the weekend. Paid a little more for this one than I might have liked to, but the interesting contracts started going fast between the one I lost and the one I ended up with. I was always willing to pay a little more for the right contract and less hassle, so we'll see if this turned out to be the better fit with more points.

We PASSED, got word today! I submitted on my birthday & 10 days later (on my deceased sister's birthday) we passed!! Love good news on a normally blah day!! Can't get over that excitement. I think all of you are the only ones who truly get it.

Thanks, we are really excited! We were looking at possibly buying some SSR points instead, but we already had some March points at BLT, so we decided if we could get a good price it would be really nice to have all our points together. It turned out perfectly! :)
 
Just wanted to say thank you to all that add to this post and especially pangyal for keeping this up to date! This has been helpful, so helpful that we made an offer yesterday! Seller accepted our offer and I will update with all of our information once it has been sent in for ROFR :)
 
Sad update here. While we passed ROFR and went quickly through estoppel, after agreeing to a contract back in MARCH, the seller has backed out of the deal. From the looks of it, prices are up, contracts are few, and we're pretty bummed.

What recourse do you have based on the contract? I assume you don't want to spend money on a lawyer to compel the sale, but the seller probably has to pay their commission already based on their listing agreement.... so that eats into any new profit they'd be hoping for.

The seller was underwater on the contract and it sounds like they were in other financial problems outside their DVC contract. The broker even waived all their commission in an attempt to help the sale go through and we waited a month for them to get the money together. One month later, surprise, there's a new emergency and they can't move forward yet again. As far as I can tell, there is little to nothing I can do at this point except start looking again. The broker could go after the seller, but that would probably be a waste as well.
 
Oh ok, they have to come up with money to sell to you at that rate. That leaves you with few options as any more money you might kick in could potentially require a new rofr/estoppel. Sorry to hear the bad news. AKV has been pretty rough lately but if you are willing to grab a stripped contract or foreign seller you might be ok. I had been watching those contracts for months and lately they have been flying off the shelves even while listings are up in the 90s.

That really stinks! I'm so sorry. :crazy2:
