Does David's tell you if the renter cancels?

I hear what you are saying but again - if no flights are allowed into Hawaii - How am I to get to Aulani to check in for a vacation that the state of Hawaii is NOT allowing and will send you home? This makes no sense to me - I can't do this if the resort was open or not - It is Not that I don't want to or changed my mind - It was changed for me by forces out of my control - I have no say so in this. Just like the fact that Orange County has stated a stay at home - they are forcing people to Not be able to take their vacations if Disney wants them to or not. I do not care to be charged with a fine of up to $5,000 just to try and take a vacation. Common Sense needs to kick in at some point in time I would think.. Or maybe I am just wrong.

I am not taking side, but step back for a moment and think about what if this is due to you or your family getting sick or injured, which would obviously be out of your control. My point is that as long as the resort is not closed or planned to be closed during your reservation, no other scenario should give you an "out" on a completely nonrefundable reservation. I understand your frustration, but if David's were to accommodate you, that would open the flood gates for other "legitimate" reasons for rescheduling, IMHO.

I do understand, but this is why renting is risky and includes it’s not refundable and to get travel insurance.

While it doesn’t seem fair, if the room is available for check in, it’s not the owner or brokers issue that you can’t be there, regardless of reason, because what you paid for is available to you. The contract isn’t contingent on a renter being able to get there.

If the resort is closed, then the room isn’t available, then expecting a reschedule or refund becomes a possibility.
 
I read they are not allowing In coming flights so if Aulani would stay open how am I to get there to be told to go home ?? I can’t go plain and simple and I really wanted to go

Before airlines, people took boats to places like Hawaii. For Florida travel, many take trains or drive their automobiles.

I am 100% in agreement with you regarding David's stance on travel bans. It's an appalling bad customer service experience to tell someone that even though a travel ban is in effect, that they won't consider a re-schedule unless the resort itself is closed. While many of us, myself included, suggested to prospective renters to book through David's for piece of mind, in the present situation a booking directly with an owner would be much better to have right now...

I’m not asking because I’m afraid to get sick I’m asking because I can’t get there and if by some miracle I would they would tell me to leave now if you all think that is fair and reasonable so be it
For what it is worth - I inquired from Dave’s about whom to purchase travel insurance from and did buy insurance - this is not covered
 


Where did you hear that they were going to allow banking of already banked points?
This is what is posted on DVC web site under travel advisory:
At this time, we have not made any changes to our Points banking or expiration policy due the impact this could have on future inventory availability. We understand this is of particular concern for Members with reservations affected by closures and/or the COVID-19 situation who may be toward the end of their Use Year. We are, however, currently evaluating various options to assist Members in this situation, but will need to delay any decisions until we better understand how long COVID-19 will impact our operations.

Disney is holding back on extending closure dates, but at this point it is inevitable. Unfortunately, their deferral limits the ability of those holding reservations to take an appropriate action. I believe it is their way of spreading out the load on their call centers - but I can't imagine what it would be like to sit on such reservation and not be able to do anything.

So, no change to banking rules, and a vague statement that they are "evaluating" options for people at the end of their use year. This contradicts your earlier statement that all points are going back to owners. Please don't fan the flames or attempt to further your arguments by stating completely erroneous information.

Yes, I know that is the case and it’s unfortunate. But, in this case, we are talking about what the contract a renter agreed to says and what remedies you would have without expecting the broker and owner to agree to a change,

This entire situation has brought to light, IMO, that these contracts are not clear enough for all parties, when things happen beyond anyones control,

Renters signed thinking about not being able to go based actions themselves.
Owners signed thinking about not providing reservation based on their actions or lack of,
Brokers developed the contracts based on the actions of each party.

What was not accounted for was the actions of others. Since that is not included, it goes back to what they say.

As already mentioned, I think it will close, and you will be able to reschedule, But I do know, I will no longer encourage people to rent unless they make sure the contract specifically outlines what would happen if the resort closes, or their are travel bans preventing travel to the resort area.

Right now, you have people who fly from N.Y., NJ, and CT , forced to self quarantine for 14 days when getting to Florida. If this is enforce when Disney opens resorts, you will have a lot of renters out of luck without owners or brokers helping them out.

That is a great solution.
- No money out of their pockets now, allows them to spread out the financial hit.
- Plus it’ll only cost them the points to owner instead of the full refund/amount paid.
- No impact to the owner? Unless they’re withholding the 30%...

FYI we are renters who received the update email this morning from Davids, they are talking about issuing travel credits in the amount of dollars paid if points expire when trying to re-rent.

Hope they can pull this off, but the math seems tricky. Like getting into ponzi scheme territory. Hopefully the company is around in 6 months so people can get their ”credit.” Probably better off getting your money back and booking again when you are ready.

However, I wouldn't feel confident in receiving a credit as the risk is too great that I wouldn't have a chance to use it. My expectation would be a refund based on the language in my contract "...the Renter will be due a refund limited to the amount paid which is $XX US Dollars." I don't see how offering a credit would help with CC disputes other than some renters agreeing to the credit rather than pursuing with a charge back. The other thing is that if David's gives a credit but then raises their rental prices per point you will need to send additional $ to secure an the same reservation. Sending additional money to a company that is showing they don't respect their contract with you is a "Fool me once, shame on you situation."

I appreciate that it is probably an attempt to keep renters who are willing to accept this from escalating further, and keep owners happy, but that’s about all the good I can say about it.

Has anyone seen an update email to OWNERS? I am an owner with a rental checking in on April 2nd. I'm sitting tight as requested, but as time goes by, I'm getting a little anxious. I know David's doesn't want us to contact renters, even though we have their contact information in the reservation, and I am sitting on my hands, waiting.

You cannot take that line out of context.The exact text of the clause is

Should accommodations not be available on date of arrival due to an action or omission by the Member, including but not limited to negligence on the part of the Member and after communication with the Intermediary, suitable comparable accommodations for the same dates cannot be secured by the Member, the Renter will be due a refund limited to the amount paid which is $XXXX.XX US Dollars.​

One could argue that there was no “action or omission” on the part of the owner.

FWIW, I wouldn’t view a credit as an acceptable offer if I had my renter’s hat on, either. And if I’m wearing my owner’s hat, I would be wary of renting my points out thru David’s in the future knowing that I might get only a fraction of what he agreed to pay me if his pyramid scheme collapsed. I wouldn’t feel confident in a rob-Peter-to-pay-Paul arrangement from either perspective.

WDW during the closed period. From everything I’ve read they are prioritizing contacting those traveling or renting out points during periods when the resorts are closed. I’m sure they’re overwhelmed with that as it is.
